Xuzhou Updates Land Acquisition Compensation Standards for 2026
Xuzhou Municipal Government has issued new comprehensive land acquisition compensation standards effective from April 28, 2026, providing clarity for foreign founders operating or investing in the region. The standards set differentiated rates for agricultural land, construction land, and unused land, and include detailed schedules for crops, trees, and structures.
Xuzhou Updates Land Acquisition Compensation Standards for 2026
Foreign founders with operations or planned investments in Xuzhou should note that the municipal government has adjusted its comprehensive land acquisition compensation standards. The new standards, published in Xu Zheng Gui [2026] No. 2, took effect upon publication on April 28, 2026, and will remain valid until December 31, 2028. The adjustment follows provincial requirements under Su Zheng Gui [2025] No. 5 and aligns with the national Land Administration Law.
Key Compensation Rates for Agricultural Land
The comprehensive compensation for expropriating collective agricultural land comprises land compensation and resettlement subsidies. It excludes social security subsidies for affected farmers and compensation for attachments and young crops, which are calculated separately. The rates vary by district:
- Gulou, Yunlong, Quanshan Districts and Xuzhou Economic and Technological Development Zone: Each is designated as a single zone with a comprehensive rate of RMB 54,000 per mu. This includes land compensation of RMB 28,000 per mu and resettlement subsidy of RMB 26,000 per person.
- Tongshan District: A single zone with a comprehensive rate of RMB 53,000 per mu, including land compensation of RMB 27,000 per mu and resettlement subsidy of RMB 26,000 per person.
- Fengxian, Peixian, Suining, Pizhou, Xinyi, and Jiawang District: Each is a single zone with a comprehensive rate of RMB 48,500 per mu, including land compensation of RMB 26,000 per mu and resettlement subsidy of RMB 22,500 per person.
Land compensation rates above are for dry land. For paddy fields, the rate increases by RMB 3,000 per mu; for vegetable plots, by RMB 14,000 per mu.
Other Land Types and Special Cases
Acquisition of collective construction land follows the comprehensive rate for agricultural land in the same zone. Collective unused land is compensated at 0.7 times that rate. For collective operational construction land obtained lawfully, compensation is determined through parcel-specific appraisal under the equal rights principle.
For large and medium-sized water conservancy and hydropower projects, compensation generally follows municipal standards unless State Council or Jiangsu Provincial Government standards are higher, in which case those higher standards apply.
Social security costs for affected farmers are managed under Su Zheng Fa [2021] No. 87 and Xu Zheng Gui [2022] No. 4.
Compensation for Crops, Trees, and Attachments
The notice includes an attachment detailing compensation for young crops, trees, and attachments. Key rates include:
- General trees: New plantations (under three years) at RMB 4,000–6,000 per mu; mature timber trees at RMB 12,000–15,000 per mu.
- Economic trees (e.g., apple, pear, jujube): Rates range from RMB 8,000 to 40,000 per mu based on trunk diameter and canopy coverage.
- Peach, plum, apricot, grape: Similar rates from RMB 8,000 to 40,000 per mu.
- Pepper trees: RMB 6,000–12,000 per mu depending on diameter.
- Mulberry fields: RMB 3,000–7,000 per mu.
- Production nursery stock: RMB 20–30 per square meter for movable plants; potted plants are not compensated.
- Deep water wells: Up to RMB 75,000 per well (including pump house and equipment).
- Greenhouses: Glass at RMB 200 per square meter; film at RMB 120 per square meter.
- Toilets: RMB 100–200 per square meter.
Compensation is not provided for trees or crops planted in cultivated fields, for excess plants beyond reasonable densities, or for potted plants. For items not listed or where standards are disputed, appraisal determines the compensation.
Compliance and Transitional Arrangements
Local authorities must strictly follow the Land Administration Law regarding scope, procedures, and compensation standards, ensuring timely and full payment of land compensation, resettlement subsidies, and compensation for rural residences, attachments, and young crops. Social security costs must also be arranged. During implementation, attention should be given to transitioning between old and new standards and mitigating legal risks. Any surplus in compensation funds after approval goes to the county-level adjustment fund; shortfalls are covered by local governments through the same fund.
For land acquisitions approved by the State Council or Jiangsu Provincial Government between January 1, 2026, and the effective date of this notice, any difference must be paid according to the new standards.
Foreign founders should factor these updated compensation costs into their land-related investments and operations in Xuzhou. For assistance with company registration and ongoing compliance in China, contact ChinaMNC on WhatsApp or WeChat at +86 153 1898 8535.
